Facing Charges In Mississippi? We Are Criminal Defense Attorneys Who Will Fight For Your Rights.

Criminal charges can turn someone’s life around, especially if they do not have a criminal defense lawyer by their side. Through our firm, Sumrall & Welch, PLLC, we bring over 70 years of combined experience as Jackson criminal defense attorneys serving clients throughout Mississippi.

Our dedicated team works tirelessly to protect the rights of those facing criminal charges in Jackson, Hinds County, Madison County, Rankin County and beyond. When your freedom and future are at stake, you need trial lawyers who understand the Mississippi criminal justice system and will fight aggressively on your behalf.

A Hands-On Approach To Defending Rights

We believe in thorough preparation and strategic defense planning for every case. As Jackson criminal defense trial lawyers, we investigate all aspects of your situation, challenge evidence when appropriate and work toward a positive outcome. Our approach begins with a free consultation where we listen to your side of the story and explain your options in clear, straightforward terms.

A criminal record can follow you for years, affecting employment, housing and other opportunities. That’s why we also help eligible clients pursue expungement to clear their records and move forward with their lives. Our attorneys understand Mississippi’s expungement laws and can determine if your case qualifies for this important legal remedy.

Protecting Your Rights Across All Criminal Matters

Whatever charges you’re facing, our experienced team is prepared to defend your rights and freedom. We handle a wide range of criminal matters, including:

  • Drug charges: From possession to distribution and trafficking cases at both state and federal levels
  • Sex crimes: Defending clients against serious allegations with sensitivity and discretion
  • Assault and battery: Representing those accused of violent offenses
  • Domestic violence: Helping clients navigate these emotionally charged cases
  • Federal crimes: Providing defense against charges in the federal court system
  • DUI: Fighting to protect your driving privileges and freedom
  • Murder charges: Offering skilled defense for the most serious criminal allegations
  • Theft crimes: Representing clients accused of property crimes
  • Felony offenses: Defending against charges that carry significant penalties

From minor misdemeanors to serious felony charges, we approach each case with the attention and strategic planning it deserves.

How Can You Get Your Criminal Charges Dropped Or Reduced In Mississippi?

It is possible to reduce or drop charges through negotiation with prosecutors, challenging evidence or proving constitutional violations occurred during your arrest or investigation. Each case is unique, and we explore all available defense strategies.

What Happens If You Are Charged With A Felony?

Felony charges typically involve more serious penalties including longer prison sentences and substantial fines. The process includes arraignment, preliminary hearings, possible grand jury proceedings and either a trial or plea agreement. Having strong legal representation from the beginning is crucial.

What Is The Difference Between A Misdemeanor And A Felony?

The penalties for misdemeanors usually are up to one year in county jail and lower fines. Meanwhile, felonies could lead to state prison sentences beyond one year and heftier fines. Felony convictions also result in the loss of certain civil rights.

The Arresting Officer Did Not Read You Your Rights. Does That Mean We Can Get The Case Thrown Out?

We have all seen the police reading the Miranda rights on television: “You have the right to remain silent,” etc. While there are situations in which the police must read these rights, there are also arrest situations in which the police are not under the same requirement.

The right to remain silent always exists in every interaction with the police. However, the requirement for the police to read that warning only applies when there is a custodial investigation. When you are in formal custody, the police have to read you your Miranda rights; if you are merely under questioning and not brought under official custody, the Miranda requirement does not apply.

Can You Hire A Criminal Defense Lawyer Before You Are Arrested Or Indicted?

Yes. Technically you are free to hire a lawyer whenever you want, and in many cases, it is helpful to have a lawyer involved before you are arrested. If you have reason to believe that you are under police investigation or that you might get arrested, call an attorney right away.

However, if you are planning to commit a crime or are in the process of committing a crime, DO NOT talk to a lawyer about that. The best thing to do is to change your course of action immediately and get out of the situation. In terms of telling your attorney: Most attorney-client conversations are privileged, meaning the court cannot compel the lawyer to disclose what you’ve said. However, there is an exception to this privilege in cases of current or future crimes. When you share these with your attorney, they may have to disclose your communication in court.

Is It Legal For The Police To Conduct A Search Without A Warrant?

Sometimes, yes.

In general, the person and property of any citizen are protected against search and seizure without a warrant. But if the officer asks if they can search your home and you say “yes,” then you have consented to a warrantless search, making the search legal. Cases of emergency also allow for searches. The police can also search your person and close surroundings as part of an arrest. Finally, if some kind of incriminating evidence is sitting out in plain view, the police can certainly use that as evidence against you in your criminal trial, without violating search and seizure restrictions.

Do You Need A Lawyer For A First-Time DUI Charge?

Yes. Well, technically you don’t “need” a lawyer. You are free to defend yourself in court or go with the public defender. However, there is a lot at stake if you are facing criminal charges. If you need to protect yourself and your future, you should only work with an experienced and knowledgeable attorney with a proven track record.
